THE GENERAL TERMS AND CONDITIONS FOR TOPPING UP PREPAID ACCOUNTS WITH A PAYMENT CARD CAN BE FOUND AT A1.SI.
A1 Slovenia, telekomunikacijske storitve, d.d., Ameriška ulica 4, 1000 Ljubljana (hereinafter: A1) is a company which provides top-up services with a payment card for prepaid accounts on the website A1.si, which is owned and administrated by A1.
A1 sets the terms and conditions for topping up prepaid accounts with payment cards via A1.si in the current Terms and Conditions, which are an integral part of A1’s Special Terms and Conditions for A1 SIMPL Services and the Special Terms and Conditions for Using A1.si – everything in the content as determined by the General Terms and Conditions for Topping Up Prepaid Accounts with a Payment Card via A1.si.
The content of A1’s General Terms and Conditions for Topping Up Prepaid Accounts with a Payment Card via A1.si is as follows:
I. Definitions
a) the General Terms and Conditions: are these general terms and conditions in accordance with which A1 provides the option of topping up prepaid accounts with a payment card via A1.si.
b) the Special Terms and Conditions: are the Special Terms and Conditions for Using A1 SIMPL Services, available at A1.si.
b) the Special Terms and Conditions for Using the Website: are the Special Terms and Conditions for Using A1.si, available at A1.si.
d) Service: is the A1 service which allows users to top up their prepaid accounts cash-free via A1.si, where payment for topping up the prepaid account is made with a payment card and is charged directly to the card holder.
e) Payment card: is a payment card, which is included in the list of payment cards in the choice of payment.
f) User: is the owner of a payment card who uses the Service. The User is not necessarily themselves a prepaid account owner, but can use the Service to top up the prepaid account of any other user of prepaid services.
g) Credit: is a positive balance on the prepaid account, which is a precondition for using prepaid services. The method, and terms, and conditions for using credit are regulated by the Special Terms and Conditions.
h) Prepaid Account: is an account that the user adds credit to. The prepaid account is tied to the prepaid user’s phone number.
i) Authorization: is the bank’s approval for paying with a payment card.
j) Bank: for the purpose of these General Terms and Conditions, bank shall mean that bank with which A1 concludes an agreement on the method of paying for goods and services online with payment cards, which determines the mutual rights and obligations of the Contracting Parties in the operation of an e-store, unless individual provisions of these General Terms and Conditions determine otherwise.
II. Service Usage Procedure
II./1. Topping up a prepaid account with a payment card comprises 5 steps:
1st step: The user enters the phone number of the prepaid user whose account they would like to top up by using the service, reenters the number, and determines the amount to be topped up. At the same time, the user must confirm agreement with the General Terms and Conditions.
2nd step: The user enters their name and surname and chooses the option of completing the purchase as a legal entity or natural person and then fills out the required information correctly, allowing them to continue the purchase process. All fields must be filled in.
3rd step:The user chooses a payment method and enters all the data necessary for authorizing the purchase: the payment card number, the expiration date, and the CVV/CVC code. At this point the user can change the name and surname which must match the name and surname listed on the chosen payment card.
4th step: The user can then review all the data previously entered in steps 1–3 and has the option of confirming the purchase. After successful authorization from the bank, the credit on the prepaid account will be increased by the amount of the top-up.
5th step: Users who are natural persons have the option of printing the receipt by clicking “Print” or “Save this receipt”. In either case the user also receives a receipt by email. Users who are legal entities will, in accordance with the Value Added Tax Act, receive a receipt in paper form by mail no later than 8 (eight) days after completing the purchase. Users who are natural persons may, within 8 (eight) days of completing their purchase, also request in writing a hard copy of their receipt by mail.
II./2. The user’s order is considered to have been received by A1 when payment authorization has been successfully completed.
II./3. After the service has been successfully completed it may not be undone and the paid amount cannot be returned, nor is it possible to transfer the paid amount to any other prepaid account.
III. Restrictions on the Use of Service
III./1. An individual user can in the same day transfer to one or more prepaid accounts a total of €125.19 from one payment card. The largest allowed amount of credit on an individual prepaid account is €200. A1 reserves the right to reject any payment that exceeds the amounts determined in this article.
III./2. The user may add credit in the amounts determined on the website and in the instructions. The website also lists additional costs the user incurs when using the service, taxes, and other charges the user must pay, along with the currency in which the service is charged.
IV. Payment Security and Service Operation
IV./1. The service operates in adherence with the 3D Secure CAP standard and with the help of the MasterCard SecureCode™ and the Visa International Verified by Visa™ authentication programs. At the same time it supports all standard security mechanisms like the CVC and CVV code, which is a 3-digit number on the signature strip on the back of the payment card. In addition to fixed, i.e. basic security elements (the card number, expiration date, traditional authorization), a new dynamic method of verifying the authenticity of all participants in the online purchasing process (card holder, point of sale, and bank) has been introduced. If the required fields are not filled out, the system automatically informs the user of this before completing payment.
V. Resolving Claims and Providing Information
V./1. Claims related to the service are handled by A1’s Customer Service. Claims must be submitted in writing no later than 15 days from the day the service was completed to the following address: A1 d.d., Naročniška služba (Customer Service), Ameriška ulica 4, Ljubljana.
VI. Rights and Obligations of A1
VI./1. A1 undertakes to do everything in its power to assure uninterrupted operation of the website and/or service, but it is not responsible for any consequences of partial or total crashing or other disruption of access to the website and/or use of the service which do not occur as a result of A1’s intentional conduct or grave negligence.
VI./2. A1 may, without advance notice, suspend the operation of the website and use of the service, if this is necessary due to maintenance work and/or any other technical reasons.
VI./3. A1 undertakes to do everything in its power to prevent unauthorized access to the website and/or unauthorized use of the service and/or any other abuse of access to the website or use of the service by users or third parties, but it is not responsible for any consequences the user or any other third party might incur due to such unauthorized access and/or use and/or any other abuse of access to the website and/or use of the service which do not occur as a result of A1’s intentional conduct or grave negligence. A1 reserves the right in the event of unauthorized access to the website and/or unauthorized use of the service and/or any other abuse of access to the website or use of the service by the user or any other party to implement measures and other actions which, in accordance with its own business judgment, it considers necessary for protecting its rights and interests and/or for protecting the rights and interests of its users and/or the rights and interests of any other parties.
VI./4. A1 undertakes to do everything in its power to provide secure transfer of confidential data over the online app, for secure storage of data and their protection from unauthorized access, abuse, loss, and alteration, but it is not responsible for any consequences the user or any other third party might incur due to such unauthorized access to confidential information or abuse thereof, or loss of or changes to information, which do not occur as a result of A1’s intentional conduct or grave negligence.
VI./5. A1 reserves the right before approving the user’s use of the service to verify all the user’s (card holder’s) information, their ability to pay, and their card’s expiration date. Furthermore A1 reserves the right to verify all information on the prepaid user, whose prepaid account is being topped up by using the service, if the user of the service (card holder) and the prepaid user are not the same person. A1 reserves the right to deny the use of the service if it determines that any of the information stated by the user in its online order form is incorrect, incomplete, or false.
VII. Rights and Obligations of the User
VII./1. The user must carefully read these General Terms and Conditions and confirm acceptance thereof before using the website and the service. If the user does not agree with these General Terms and Conditions, then they may not use the service. A user who confirms acceptance of these General Terms and Conditions and who uses the website and service is considered to have also agreed with the Special Terms and Conditions and Special Terms and Conditions for Using the Website.
VII./2. The user assures A1 that all the information necessary for using the service and which the user must submit to A1 for completing payment and approving authorization is true, correct, accurate, and complete. Otherwise the user is liable to A1 for any damage incurred.
VII./3. The user assures A1 that they are capable of settling all financial obligations arising from the use of the service. Otherwise the user is liable to A1 for any damage incurred.
VII./4. The user expressly agrees that A1 may collect and process the information submitted by the user as part of using the service, and that it may forward such information to the bank for authorizing payment and processing data.
"VII./5. The user expressly assures A1 that they shall:
• not abuse or attempt to abuse the website and/or service and/or payment card
• not access or attempt to access the website without authorization
• not use or attempt to use the website or service in an unauthorized manner Otherwise the user is liable to A1 for any damage incurred."
VIII. Relationship between the General Terms and Conditions, Special Terms and Conditions, and Special Terms and Conditions for Using the Website
VIII./1. Wherever the General Terms and Conditions are not in accord with the Special Terms and Conditions and/or Special Terms and Conditions for Using the Website, the General Terms and Conditions take precedence.
VIII./2. For whatever the General Terms and Conditions do not determine or do not determine otherwise, the Special Terms and Conditions and/or Special Terms and Conditions for Using the Website apply, wherein the General Terms and Conditions must be applied mutatis mutandis. IX. Final Provisions
IX./1. These General Terms and Conditions for Topping Up Prepaid Accounts with a Payment Card on A1.si come into force on 20 April 2017.
